1. Company Information
Everest Atelier is a jewellery house registered in Im Graben 580 H, 3758 Latterbach, Switzerland , specialising in fine jewellery, lab‑grown diamonds, custom design, diamond sourcing, and the sale of pre-designed jewellery pieces.
Contact details and further company information are available in the website footer.
2. Scope of Application
These Terms & Conditions apply to:
- use of the Everest Atelier website;
- submission of inquiry and customization forms;
- free consultations;
- custom design services;
- diamond sourcing services;
- purchase of pre-designed jewellery;
- production, delivery, and related services.
Information presented on the website does not constitute a binding offer. A submitted form or inquiry does not create a contract or order.
3. Nature of the Offer
All jewellery pieces and services offered by Everest Atelier are individual in nature.
Jewellery available in the online store is offered as made‑to‑order pieces based on Everest Atelier’s ready designs. Production begins only after the client completes the purchase. These pieces are not held as finished stock.
Availability of materials, diamonds, and production capacity may change at any time.
Each custom or made‑to‑order project is developed specifically for the client and reflects both aesthetic and technical considerations.
4. Inquiry & Customization Form
The customization form serves solely as a non‑binding briefing tool. Submission of the form does not constitute an order or contractual obligation.
Following submission, the client is offered a free consultation.
5. Free Consultation
The free consultation is advisory in nature. During the consultation:
- the project scope and feasibility are discussed;
- sourcing and design options are evaluated;
- timelines and costs are communicated;
- the client’s preferred deadline may be reviewed.
Any conclusions or estimates discussed during the consultation become binding only after formal payment by the client. Payment constitutes the legally binding acceptance of the agreed scope, design, timeline, and price.
6. Custom Design Process
The custom design process generally follows these stages:
- project brief;
- design development and visualisations;
- client approval of the design;
- payment;
- production;
- final visual approval;
- shipment.
Design images, renders, and visualisations are illustrative. The final piece may differ slightly in appearance due to materials, craftsmanship, and technical requirements.
7. Diamond Sourcing as a Separate Service
Diamond sourcing is offered as a standalone service.
- Submission of the sourcing form and the subsequent consultation are free of charge.
- After mutual acceptance of the sourcing brief, the client pays a deposit of EUR 200, calculated according to the EUR exchange rate on the date of brief acceptance.
The deposit:
- partially covers the cost of the diamond if one is sourced and accepted by the client;
- becomes binding upon payment and marks the formal completion of the sourcing brief stage.
The deposit is refundable only if sourcing proves impossible due to market limitations or the client’s stated deadline.
Sourcing is formally completed once the remaining balance is paid and the sourced diamond is accepted by the client.
8. Pricing & Payments
Prices are determined individually for each project.
- The final price is fixed on the date the design is approved, based on material and gold prices on that day.
- Full payment formally closes the design and order stage and initiates production.
- A sourcing deposit formally closes the sourcing brief stage.
Once payment or deposit has been made, cancellation by the client is not possible.
9. Changes and Modifications
After design approval and payment or deposit:
- changes may be considered at Everest Atelier’s discretion;
- changes depend on technical feasibility and the stage of production;
- changes may require additional payment.
Price reductions or refunds resulting from design changes are excluded due to the custom‑made nature of the work and prior material procurement.
10. Diamonds, Materials, and Craftsmanship
Diamond grading is based on recognised laboratory certificates (e.g., IGI, GIA). Everest Atelier provides expert guidance and professional recommendations throughout the sourcing and design process; final decisions are made jointly with the client based on informed approval. (e.g., IGI, GIA). Certificates do not fully capture visual appearance.
Clients receive expert guidance beyond the certificate, including explanation of how a stone appears and behaves in real conditions.
Final acceptance is based on both documented specifications and informed client approval. Where no deviations are observed, the client is explicitly informed.
11. Metals and Wear
The final price reflects gold prices on the date of design approval.
Signs of wear such as patina, micro‑scratches, or surface changes are a natural result of use and are not covered by warranty.
Weight is not a guaranteed parameter due to handcrafted production methods.
12. Production Timeframes
Clients may indicate time preferences in the inquiry or order process.
Made‑to‑order store pieces
Jewellery purchased from the Everest Atelier store is produced after the order is placed.
- Production time: up to 4 weeks from payment confirmation.
- Delivery time: up to 7 business days, depending on destination.
Custom design and sourcing
Production timelines for custom design and sourcing services are:
- confirmed during the free consultation;
- binding once confirmed and paid;
- dependent on project scope and availability.
As guidance only:
- brief specification typically does not exceed one week;
- production and delivery usually take up to five weeks.
For sourcing services, timelines depend strongly on market availability and client priorities and are defined during consultation.
13. Delays and Responsibility
If delays occur due to Everest Atelier, the client is entitled to compensation equal to 30% of the order value.
Everest Atelier is not responsible for delays caused by shipping providers. Courier complaints must be addressed directly by the client with the carrier.
14. Final Approval and Delivery
Upon completion, the client receives photos or video for final visual approval. Final visual approval confirms aesthetic acceptance and does not waive the client’s right to claim a manufacturing defect.
Payment constitutes formal closure of the purchase, order, or design stage.
- Shipping is arranged after approval.
- Delivery typically occurs within five business days.
- Shipments are insured for full value.
- Risk transfers to the client upon successful delivery.
15. Returns, Complaints, and Repairs
Custom‑made and custom‑sourced pieces are not eligible for returns.
For custom‑sourced diamonds, exchange for store credit or other jewellery may be offered.
Manufacturing defects are remedied through repair rather than refund. A manufacturing defect does not include natural characteristics of materials or gemstones, variations previously discussed and accepted, normal wear, or subjective aesthetic preferences.
16. Intellectual Property
Designs created from scratch in collaboration with a client belong to the client and may be executed by another jeweller.
Everest Atelier retains the right to present completed projects, images, and designs for portfolio or marketing purposes without personal data. Clients may object by contacting Everest Atelier.
17. Subjective Expectations
Aesthetic preferences and subjective impressions do not constitute grounds for claims. Jewellery naturally evolves over time through wear.
18. International Orders, Taxes, and Customs
All prices are gross. VAT, customs duties, and applicable taxes are covered by Everest Atelier.
International shipments may require contact from customs authorities. If additional charges arise, clients should contact Everest Atelier so they may be addressed directly with authorities. Independently paid invoices submitted by clients cannot be reimbursed.
19. Limitation of Liability
Liability is limited to the maximum extent permitted by law and, in all cases, to the amount paid by the client for the relevant product or service. Everest Atelier is not liable for indirect, consequential, or incidental damages, or for misuse of jewellery.
20. Force Majeure
Everest Atelier is not responsible for failure or delay due to events beyond reasonable control, including natural disasters, supply chain disruptions, diamond or material availability, precious metal market fluctuations, customs restrictions, transport limitations, or governmental actions.
21. Governing Law and Jurisdiction
These Terms & Conditions are governed by Swiss law. Exclusive jurisdiction lies with the courts of Switzerland.
22. Final Provisions
If any provision is found invalid, remaining provisions remain effective. Amendments must be published on the website. In case of translations, the English version prevails.
